Federal Judge Blocks Title IX Rule on Gender Identity for Texas Colleges, Schools

A federal judge has approved an injunction against the U.S. Department of Education’s Title IX final rule for public colleges and schools across Texas. Title IX is the federal law that prohibits sex-based discrimination in educational programs or activities that receive federal funding. Among other changes, the final rule redefines sex-based harassment as including harassment based on sex stereotypes, sex characteristics, pregnancy and related conditions, sexual orientation, and gender identity. “The Final Rule inverts the text, history, and tradition of Title IX,” U.S. District Judge Matthew Kacsmaryk of the Northern District of Texas wrote in his July 11 order granting the injunction. “The statute protects women in spaces historically reserved to men; the Final Rule inserts men into spaces reserved to women.”...
