Ninth Circuit Revokes Homeless Encampment Injunction Following Supreme Court Ruling

SAN FRANCISCO—The Ninth Circuit U.S. Court of Appeals issued an order on July 8 clearing the way for San Francisco to sweep public homeless camps. In an ongoing lawsuit that the Coalition on Homelessness filed against San Francisco, a preliminary injunction prevented the city from enforcing its laws against camping on public property, a press release stated. The injunction was granted in December 2022, and it invoked the Eighth Amendment, which forbids cruel and unusual punishment. However, the U.S. Supreme Court found on June 28 in a different case that enforcement of laws against public camping does not count as cruel and unusual punishment.
